OBJECTIVES OF THE CHENNAI ARBITRATION CENTRE

To encourage and bring about amicable settlement of spites arising in the course of domestic and international commercial transactions and trade by mediation or conciliation or otherwise;

The CAC Arbitration Rules provide for a flexible, speedy and efficient procedure for resolving all commercial or economic disputes of a national or international nature through arbitration. Parties to a dispute shall be bound by the provisions of the present Rules by signing an arbitration clause nominating CAC as the arbitration institution.

 

The CAC Panel/List of Arbitrators consists of arbitrators from India and abroad. The aim of the Panel/List is to provide the CAC Secretariat with a searchable source. To register for inclusion on the CAC Panel/List of Arbitrators, please contact us. Please kindly note that registration on the Panel/List is for information purpose only; it does not guarantee appointment as an arbitrator.

The CAC Rules of Ethics for Arbitrators provide ethical guidelines for the CAC Arbitrator so that he or she conducts his or her arbitrator's mission efficiently, observing the principles of fairness, neutrality, and confidentiality.

 

OBJECTIVES OF THE CHENNAI ARBITRATION CENTRE

I. Dispute Resolution & Settlement
  • To encourage and bring about the amicable settlement of disputes arising in the course of domestic and international commercial transactions and trade, through mediation, conciliation, or other alternative dispute resolution mechanisms.

  • To arbitrate and/or arrange for arbitration, mediation, or conciliation for parties who refer their commercial disputes to the Chennai Arbitration Centre, in accordance with the rules framed by the Centre and within the scope of the Arbitration and Conciliation Act, 1996 (as amended) and other statutory provisions.

  • To arbitrate and/or arrange for arbitration, mediation, or conciliation for matters referred by Courts to the Chennai Arbitration Centre, ensuring resolution in compliance with the terms of referral and the Arbitration and Conciliation Act, 1996 (as amended).


II. Promotion of ADR Mechanisms
  • To promulgate and disseminate the idea of Alternative Dispute Resolution (ADR) modes, including arbitration, for resolving commercial disputes arising in domestic and international trade among commercial and trading parties.

  • To encourage the use of mediation clauses, arbitration clauses, and med-arb clauses in domestic and international business contracts and agreements.

  • To draw up standard arbitration clauses and model rules of arbitration procedure for adoption by contracting parties.

  • To create and promote awareness of ADR modes among the domestic and international commercial trade industry, the general public, and students.


III. Education, Training & Certification
  • To disseminate information and educational material concerning arbitration processes, laws, rules, procedures, techniques, facilities, and international conventions.

  • To conduct training programs, workshops, and seminars in arbitration and mediation.

  • To conduct assessments of trained arbitrators and certify arbitrators who have acquired the requisite skills.

  • To retain panels of certified arbitrators who may be appointed for cases referred to the Chennai Arbitration Centre.

  • To offer training facilities for personnel in arbitration techniques, arrange fellowships, and furnish experts competent to advise on arbitration legislation and procedures.

  • To organize seminars, study groups, and lectures on legal and practical problems relating to arbitration legislation and procedures.

  • To engage trainees or investigators to study problems, methods, and techniques in arbitration, both in India and abroad.


IV. Research, Publication & Information
  • To prepare, print, and publish papers, periodicals, pamphlets, bulletins, and brochures containing information concerning arbitration, mediation, and other ADR methods existing in India and abroad.

  • To publish arbitral awards and judicial decisions pertaining to arbitration, along with research data and related matters.

  • To furnish names of persons suitable for appointment as arbitrators and publish information concerning fees charged under various arbitration procedures.

  • To promote research in the field of law and alternative dispute resolution.

  • To establish and maintain a reference library with reading and writing rooms, equipped with online databases, books, reviews, magazines, newspapers, and other publications on arbitration matters.


V. National & International Collaboration
  • To work in partnership with national and international organizations and foreign arbitral bodies on matters touching upon international commercial arbitration.

  • To send delegations abroad and invite representatives of such organizations and bodies for the purpose of knowledge exchange and collaboration.

  • To promote arbitration service agreements between India and other countries, containing provisions for the adoption of joint clauses and procedures.


VI. Free Legal Aid & Social Objectives
  • To provide free legal aid and services to indigent persons with respect to arbitration proceedings and processes, as per the rules framed by the Society.


VII. Administrative & Financial Powers
  • To impose and recover affiliation and other fees and charges for services rendered.

  • To accept grants, donations, and subscriptions, whether in cash or securities, and any property—movable or immovable—in furtherance of the objects of the Society.

  • To borrow and raise moneys, with or without security, or on the security of a mortgage, charge, hypothecation, or pledge of all or any of the Society’s assets.

  • To acquire, purchase, take on lease or license, or otherwise acquire any land, building, or other entities necessary for carrying out the purposes of the Society.

  • To sell, lease, mortgage, exchange, hire, or otherwise transfer any properties of the Society.

  • To invest funds or moneys entrusted to the Society in such securities and in such manner as may be determined from time to time.

  • To undertake and accept the management of any endowment or trust fund having objects similar to the objects of the Society.
